Terms of Service

These Terms govern your use of In Season (the "Service") at joininseason.com, operated by Well Made Decisions LLC ("we," "us"), a Wyoming limited liability company. By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

In Season is a personal digital wardrobe. You can catalog the clothing and accessories you own, save finds you are considering, build and save outfits, and find your color season. The Service is offered on a subscription basis with a free trial, as described in Section 5. The Service is offered as is and features may change over time.

2. Your account

You must be at least 18 years old to create an account, and you confirm that you are when you sign up. You are responsible for keeping your password confidential and for activity that occurs under your account. Provide accurate information and keep it current. Notify us at privacy@joininseason.com if you believe your account has been compromised.

3. Your content

Your closet is yours. You retain all rights to the photos, item details, and outfits you add ("Your Content"). You grant us a limited license to store, process, and display Your Content solely to provide the Service to you. We do not publish Your Content, share it with other users, or use it for advertising or to train any model. You are responsible for having the right to upload any photo you add, and for not uploading unlawful content.

5. Subscription, free trial, and billing

New accounts start with a 15-day free trial. To begin the trial you choose a plan and provide a payment method through Stripe. You are not charged during the 15-day trial. Current plans are $8.99 per month or $79 per year (prices may change on notice).

At the end of the 15-day trial your payment method is automatically charged for the plan you selected, and your subscription then renews automatically at the end of each billing period at the then-current price, until you cancel. You authorize us to charge your payment method for the first charge after the trial and for each renewal.

You can cancel at any time from your account (which opens our payment provider's secure portal) or by emailing payments@joininseason.com. If you cancel during the trial, you are not charged. If you cancel after the trial, your subscription remains active through the end of the current billing period and does not renew after that. You are responsible for any applicable taxes. Refunds are governed by our Refund Policy.

6. When a subscription ends: read-only access

If your trial ends without a subscription, or your subscription is canceled or lapses, your account moves to read-only access: you can still sign in and view the closet, looks, and finds you already created, and existing retailer links continue to work, but you cannot add or change items until you subscribe again. We may limit or change read-only access in the future on notice.

7. Inactivity and data deletion

If your subscription has ended and your account is in read-only access, and you do not sign in for 60 days, we delete the account and its content. Active and trialing accounts are not deleted for inactivity; to keep a lapsed account, sign in from time to time or resubscribe.

You can also permanently delete your account and all its data yourself at any time from the account menu in the app (we ask you to confirm, since deletion cannot be undone), or by emailing privacy@joininseason.com. Keep your own copies of anything you want to retain.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WELL MADE DECISIONS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Well Made Decisions LLC from claims arising out of your use of the Service, Your Content, your violation of these Terms, or your violation of any law or third-party right.

11. Intellectual property

The Service, including its software, design, and marks, is owned by Well Made Decisions LLC. These Terms do not grant you rights to our trademarks or software beyond using the Service as intended.

12. Termination

We may suspend or terminate access for violation of these Terms or to protect the Service. If we terminate your paid access for a violation, no refund is due. If we terminate for convenience during a paid period, we will refund the unused portion of that period.

13. Third-party services

The Service depends on third-party providers, including Stripe for payments and Cloudflare for hosting and storage. We are not responsible for their acts or omissions, and your use of Stripe checkout is also subject to Stripe's terms.

Affiliate links. Some links to retailers in Finds are affiliate links. If you buy through one, we may earn a commission at no additional cost to you. This does not affect the price you pay, and we are not responsible for retailers, their products, or their prices.

14. Electronic communications

You consent to receive communications from us electronically, and you agree that emails to the address you provided satisfy any legal requirement that a communication be in writing. Notices to us should be sent to privacy@joininseason.com.

15. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. The exclusive venue for disputes is the state or federal courts located in Wyoming, and you consent to their jurisdiction.

16. Dispute resolution

Any dispute will be resolved on an individual basis. You and we each waive any right to participate in a class, consolidated, or representative action, and each waive trial by jury. Either party may bring an individual claim in small claims court. Any claim relating to the Service must be filed within one (1) year after it arises, or it is permanently barred.

17. General

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, sale, or reorganization. Sections 3, 8, 9, 10, 11, and 16, and this section, survive termination.

18. Changes

We may update these Terms. Continued use after changes means you accept them, and we will revise the "Last updated" date above.
